Many times when people are choosing potential guardians for their minor children they will choose a couple. “My sister and her husband will be our primary guardians, and my husband’s brother and his wife will be our alternates.”
I always ask another questions after this – if only one person in the couple was available when the time came, would you want that person to serve alone? If your sister had passed away, would you want her husband to be the guardian, or would you want to move down the list to your husband’s brother?
You want to be clear on this so that your attorney can draft the legal documents in a way that will make sure your wishes can be honored, and not have your family and the Court trying to guess at what you meant when you are no longer around.
So, today’s task:
- If you haven’t nominated guardians, take a few minutes to think about (and talk about) whom you’d want to serve as guardian.
- If you have nominated guardians, take a look at your Guardianship Proxy document and your Will and make sure the nominations are clear.
